(17) por los delitos  de homicidio frustrado, por el atropello que dej\u00f3 con graves lesiones a una funcionaria de la PDI la tarde del martes en Temuco, y por no detenerse para brindar auxilio a la v\u00edctima.  <\/p>\n\n\n\n<p>Acogiendo la solicitud del fiscal Juan Pablo Gerli, el tribunal de garant\u00eda decret\u00f3 la internaci\u00f3n provisoria del menor, quien registra condenas como adolescente por hurto y robo de veh\u00edculos.  <\/p>\n\n\n\n<p>\u201cEn este caso se formaliz\u00f3 investigaci\u00f3n por el delito de homicidio frustrado, porque se estima que el imputado realiz\u00f3 la conducta con dolo eventual, esto se puede colegir de las circunstancias de que el imputado conduce a muy alta velocidad, ve una luz roja,  no puede no haber visto a la peat\u00f3n y de igual forma cruza atropellando a la v\u00edctima y dej\u00e1ndola gravemente lesionada\u201d, explic\u00f3 el fiscal Gerli, destacando que la conducta desplegada por el imputado supera el est\u00e1ndar de culpa o negligencia propia de una cuasidelito.<\/p>\n\n\n\n<p>Respecto del imputado Juan Manuel Cabrera Chavez, due\u00f1o del veh\u00edculo que conduc\u00eda el menor cuando arroll\u00f3 a la funcionaria policial en Av, Caupolic\u00e1n, el fiscal le comunic\u00f3 que se realiza una investigaci\u00f3n en su contra como encubridor en el homicidio frustrado y por uso fraudulento de placas patentes. \u201cRealiz\u00f3 diversas maniobras como pintar el veh\u00edculo, cambiar las patentes con el fin de ocultarlo, adem\u00e1s de dejarlo en un predio de un pariente en un sector rural\u201d, detall\u00f3 el persecutor.<\/p>\n\n\n\n<p>En su caso el tribunal de garant\u00eda no acogi\u00f3 la solicitud de prisi\u00f3n preventiva y decret\u00f3 en el arresto domiciliario total.
